Agreement to Terms of Use

These Terms of Use govern your access to and use of all programs, products, and services offered by Sunshine Intuitive, L.L.C. ("Company," "we," or "us"). The term "you" refers to any purchaser and/or user of any of our Programs, Products, and/or Services.

By purchasing, accessing, or using any of our Programs, Products, or Services, you are agreeing to these Terms of Use as they appear and are legally bound by them, whether or not you have read them. If at any time you do not agree with these Terms of Use, please do not use our Programs, Products, or Services.

We reserve the right to update or change these Terms of Use at any time without prior notice. Your continued use of our Programs, Products, or Services after any changes constitutes your acceptance of the revised Terms.

Nature of Services

Our Programs, Products, Services, and Program Materials are for informational, educational, and spiritual exploration purposes only. Psychic readings, mediumship sessions, and intuitive coaching are not a substitute for professional medical, mental health, legal, or financial advice.

Results from sessions are not guaranteed. The information provided during any session or through any materials is subject to the client's own personal interpretation. Sunshine Intuitive, L.L.C. makes no claims, promises, or guarantees about the accuracy, completeness, or usefulness of any information provided.

Medical Disclaimer

Our Programs, Products, Services, and Program Materials are not to be perceived as or relied upon in any way as medical advice or mental health advice. The information provided is not intended to be a substitute for professional medical advice, diagnosis, or treatment that can be provided by your own physician, therapist, counselor, mental health practitioner, or any other licensed health care professional.

Do not disregard professional medical advice or delay seeking professional advice because of information received through our services. Do not stop taking any medications without speaking to your health care provider. If you have or suspect that you have a medical or mental health issue, contact your own health care provider promptly.

Sunshine Intuitive, L.L.C. is not providing health care, medical, or nutrition therapy services and is not attempting to diagnose, treat, prevent, or cure any physical ailment, mental or emotional issue, disease, or condition.

Legal & Financial Disclaimer

Our Programs, Products, Services, and Program Materials are not to be perceived or relied upon in any way as business, financial, or legal advice. The information provided is not intended to be a substitute for professional advice from your own accountant, lawyer, or financial advisor.

You are advised to consult with your own accountant, lawyer, or financial advisor for any questions regarding your income, taxes, or financial situation. Sunshine Intuitive, L.L.C. is not responsible for your earnings, the success or failure of your business decisions, or any other financial result.

Limitation of Liability

To the fullest extent permitted by law, Sunshine Intuitive, L.L.C. expressly excludes any liability for any direct, indirect, or consequential loss or damage incurred by you or others in connection with our Programs, Products, Services, and Program Materials, including without limitation any liability for:

• Accidents, delays, injuries, harm, loss, or damage of any kind
• Physical, mental, emotional, or spiritual injury or harm
• Loss of income, revenue, business, profits, or contracts
• Loss of data, loss of goodwill, or wasted time
• Any other loss or damage, however caused, whether by negligence, breach of contract, or otherwise

You specifically acknowledge and agree that Sunshine Intuitive, L.L.C. is not liable for any defamatory, offensive, or illegal conduct of any other participant or user.

Disclaimer of Warranties

Cancellation & Refund Policy

All session fees are non-refundable. Booking a session reserves your time exclusively, and that time cannot be offered to anyone else once reserved.

Each session includes one complimentary reschedule, provided at least 48 hours notice is given prior to the scheduled session. Cancellations with less than 48 hours notice, or a no-show, will result in forfeiture of the session fee. Rescheduled sessions must take place within 90 days of the original booking date.

Sunshine Intuitive, L.L.C. reserves the right to cancel or reschedule a session in the event of illness, emergency, or circumstances beyond our control. In such cases, a full reschedule will be offered.

Client Conduct & Right to Refuse Service

Sunshine Intuitive, L.L.C. is committed to maintaining a respectful, safe, and supportive environment for all sessions. We reserve the right to cancel or terminate a session at any time if a client is deemed to be in an unsuitable emotional state to receive this work, is behaving disrespectfully, or if the mutual respect and safety of the session is not upheld.

In such circumstances, session fees are non-refundable. We also reserve the right to refuse future bookings at our sole discretion.

Intellectual Property

All content included in our Programs, Products, Services, and Program Materials — including but not limited to text, graphics, audio recordings, video recordings, written materials, and session content — is the property of Sunshine Intuitive, L.L.C. and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our content without our prior written permission. Session recordings provided to clients are for personal use only and may not be shared, published, or redistributed in any form.

Recording Policy

Sunshine Intuitive, L.L.C. does not record sessions by default. Clients are welcome to record sessions on their own device for personal use only.

By recording a session, you agree that the recording is for your personal use only and will not be shared publicly, posted on social media, or distributed in any form without the prior written consent of Sunshine Intuitive, L.L.C..

Privacy

Sunshine Intuitive, L.L.C. respects your privacy and is committed to protecting your personal information. All information shared during sessions is treated with strict confidentiality and will not be shared with third parties without your consent, except as required by law.

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference.

Technology & Service Availability

We make every effort to ensure that the delivery of our Programs, Products, Services, and Program Materials is uninterrupted and error-free. However, we cannot guarantee that your access will not be suspended or restricted from time to time, including to allow for repairs, maintenance, or updates.

To the fullest extent permitted by law, Sunshine Intuitive, L.L.C. will not be liable to you for damages or refunds should our Programs, Products, Services, or Program Materials become unavailable or inaccessible due to any reason, including system failures, internet outages, or circumstances beyond our control.

Virtual sessions are conducted via Zoom. It is your responsibility to ensure that Zoom is installed and functioning on your device prior to your scheduled session. Technical difficulties on the client's end do not entitle the client to a refund or reschedule outside of the standard cancellation policy.

Errors & Omissions

We make no warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information in our Programs, Products, Services, and Program Materials. Every effort has been made to present the most accurate and up-to-date information, but we cannot be held responsible for any inaccuracies or errors to the fullest extent permitted by law.

Links to Third-Party Websites

We may provide links to third-party websites for your convenience. The inclusion of any link does not imply our endorsement, sponsorship, or approval of that website or its owner. We assume no responsibility for the content, accuracy, or practices of any third-party websites and accept no liability for any loss or damage that may arise from your use of them.

Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms of Use or your use of our Programs, Products, or Services shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be subject to binding arbitration in Wisconsin in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

Severability

If any provision of these Terms of Use is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from these Terms & Conditions and shall not affect the validity or enforceability of the remaining provisions.

Entire Agreement

These Terms of Use, together with our Privacy Policy and any booking confirmation or release form provided at the time of scheduling, constitute the entire agreement between you and Sunshine Intuitive, L.L.C. with respect to your use of our Programs, Products, and Services, and supersede all prior agreements, understandings, or representations.

Psychic & Mediumship Disclaimer

Psychic readings and mediumship sessions are provided for entertainment, spiritual exploration, and personal reflection purposes only. Each client's consultation is subject to the client's own personal interpretation. Sunshine Intuitive, L.L.C. makes no guarantees regarding the outcome, accuracy, or content of any session.

No session should be used as a substitute for professional advice of any kind. Sunshine Intuitive, L.L.C. is not responsible for any decisions made by a client as a result of a session.

Indemnification

You agree to defend, indemnify, and hold harmless Sunshine Intuitive, L.L.C. and any of its affiliates, representatives, and service providers from and against any and all legal claims, demands, liabilities, damages, losses, and expenses — including reasonable attorney's fees and court costs — arising out of or related to:

• Your use or misuse of our Programs, Products, or Services
• Your breach of any provision of these Terms of Use
• Your conduct or actions in connection with any session or program
• Any violation of applicable law or the rights of a third party

Sunshine Intuitive, L.L.C. reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

Chargebacks & Payment Disputes

All session fees are non-refundable as described in our Cancellation & Refund Policy. You agree to contact Sunshine Intuitive, L.L.C. directly at info@sunshineintuitive.com to resolve any billing concerns before initiating a dispute with your bank or credit card issuer.

In the event that you initiate a chargeback or payment dispute with your financial institution, you acknowledge and agree that you will be responsible for any costs incurred by Sunshine Intuitive, L.L.C. in responding to or contesting the dispute, including service charges and reasonable attorney's fees. Initiating a chargeback will result in the immediate loss of access to any purchased or scheduled services until the matter is resolved.

Maximum Liability

Notwithstanding any other provision of these Terms of Use, the maximum aggregate liability of Sunshine Intuitive, L.L.C. arising from or relating to your use of our Programs, Products, or Services — whether based on contract, tort, negligence, strict liability, or otherwise — is limited to the greater of:

• One hundred dollars ($100.00) USD, or
• The total amount you paid to Sunshine Intuitive, L.L.C. in the six (6) months immediately preceding the event giving rise to the claim

This limitation applies to any and all claims, including but not limited to lost profits, consequential damages, punitive damages, and claims arising from negligence or fraud.

Force Majeure

Sunshine Intuitive, L.L.C. is not liable for any failure or delay in performing its obligations under these Terms of Use due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, illness or medical emergency, acts of civil or military authority, government restrictions, internet or technology outages, power failures, or other unforeseen circumstances.

In the event of such circumstances affecting a scheduled session, Sunshine Intuitive, L.L.C. will make reasonable efforts to reschedule at a mutually convenient time.
